1. CITY OF RIVERGROVE PUBLIC NOTICE
TYPE III CONDITIONAL USE PERMIT AND DEVELOPMENT PERMIT APPLICATION
NOTICE IS HEREBY GIVEN THAT public hearings will be held by the Rivergrove Planning Commission at or shortly after 7:00 PM on Monday, November 21, 2022, via Zoom to consider the following request:
Request: A Type III Conditional Use Permit and Development Permit to demolish an existing single-family home and construct a new dwelling on the property.
Applicant: Curt and Jan Taylor
Location: 5036 Dogwood Drive
The public hearing on this matter will be conducted pursuant to the rules of procedure adopted by the Planning Commission. Oral and written testimony in favor of or in opposition to the request will be received during the hearing. Written comments may be submitted prior to the hearing by mailing to Heather Kibbey, City Manager/Recorder, City of Rivergrove P.O. Box 1104, Lake Oswego, OR 97035 or at manager@cityofrivergrove.com no later than 5 P.M. November 21, 2022. The decision to approve or deny the application will be based on compliance with the following ordinance criteria:
Rivergrove Land Development Ordinance (RLDO) Article 4 Sec. 4.010-4.110 Review Procedures; Article 5 Sec. 5.010-5.100 Residential Zone, Sec. 5.020 Flood Hazard District, Article 6 Sec. 6.300-6.340

Copies of the application information can be obtained at cost and are available for review by contacting the City Manager/Recorder, at 503-639-6919. Any questions regarding the application should also be addressed to the City Manager/Recorder. A staff report will be available for inspection on or about November 14, 2022 (contact the City Manager/Recorder to see the report or obtain a copy provided at cost).
Issues regarding compliance with pertinent code standards may provide the basis for an appeal to the Land Use Board of Appeals and shall be raised and submitted before the record is closed. Issues must be raised with sufficient specificity to enable the Planning Commission to respond to the issue. Failure to raise an issue in person or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals on that issue.
In addition, failure to raise constitutional or other issues relating to proposed conditions of approval, with sufficient specificity to allow the Planning Commission to respond to the issue, precludes an action for damages in circuit court.
The Planning Commission shall review the applications under a Type III procedure and make a decision according to the applicable criteria specified above. This hearing may be continued without additional published notices. All interested persons are invited to attend and be heard.
