Special City Council Meeting

NOTICE IS HEREBY GIVEN THAT a public hearing will be held at a special meeting of the Rivergrove City Council at or shortly after 7:00 PM on January 22, 2018, in the library of the River Grove Elementary School at 5850 SW McEwan Road, Lake Oswego, OR to consider the following request:

Request: A Type II Development Permit approval to modify the previously submitted Type III Development Permit and Conditional Use Permit to construct a single-family dwelling partially in the 100-Year Floodplain, including certain revisions regarding tree preservation/removal and Type II Hardship Relief approval as necessary.

Applicant:  Larry Todd, Maywood Homes, Inc., PO Box 210, Lake Oswego, OR 97034

Property Location:  4620 SW Dogwood Drive; Lot 15 Pilkington plat, Clackamas County (Map 2 1E 19AD; Tax Lot 2901)

The public hearing on this matter will be conducted pursuant to the rules of procedure adopted by City Council. Oral and written testimony in favor of or in opposition to the request will be received during the hearing.  Written comments may be submitted prior to the hearing by mailing to Leanne Moll, City Recorder, City of Rivergrove, P.O. Box 1104, Lake Oswego, OR 97035 no later than January 19, 2018.  The decision to approve or deny the application will be based on compliance with the following ordinance criteria:

  • Ordinance 70-2001 Section V. Flood Management Conditional Uses and Water Quality Development Standards
  • Rivergrove Land Development Ordinance Sections 4.010 to 4.110 Type III Procedures; Sections 5.010 to 5.100 Flood Hazard District; Residential Zone Permitted Uses and Tree Cutting; Section 6.231 Site Review; and Article 8 Public Deliberations & Hearings
  • Criteria for decisions on Type II Hardship Relief listed under Section 6.060 (a) & (b) as necessary.

Issues regarding compliance with pertinent code standards may provide the basis for an appeal to the Land Use Board of Appeals and shall be raised and submitted before the record is closed.  Issues must be raised with sufficient specificity to enable City Council to respond to the issue.  Failure to raise an issue in person or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue precludes appeal to the State Land Use Board of Appeals on that issue.  In addition, failure to raise constitutional or other issues relating to proposed conditions of approval, with sufficient specificity to allow City Council to respond to the issue, precludes an action for damages in circuit court. 

City Council shall review the application under a Type II procedure and make a decision to approve or deny the application according to the applicable criteria specified above.  All interested persons are invited to attend and be heard.
