Public Hearing
A Type III Conditional Use Permit and Development Permit to construct a detached garage with an apartment unit above for applicants Amy and Jerry Anderson at 6550 Childs Road
The public hearing on this matter will be conducted pursuant to the rules of procedure adopted by the Planning Commission. Oral and written testimony in favor of or in opposition to the request will be received during the hearing. Written comments may be submitted prior to the hearing by mailing to Heather Kibbey, City Manager/Recorder, City of Rivergrove, PO Box 1104, Lake Oswego, OR 97035 or by email no later than 5 p.m. April 15, 2021. The decision to approve or deny the application will be based on compliance with the following ordinance criteria:
- Rivergrove Land Development Ordinance Section 4.010-4.110 Review Procedures; Article 5 District and Zones Section 5.010-5.100
- Ordinance 70-2001 Rivergrove Flood Ordinance
Copies of the application information can be obtained at cost and are available for review by contacting the City Manager/Recorder at (503) 639-6919. Any questions regarding the application should also be addressed to the City Manager/Recorder. A staff report will be available for inspection on or about April 8, 2021 (contact the City Manager/Recorder to see the report or obtain a copy provided at cost).
Issues regarding compliance with pertinent code standards may provide the basis for an appeal to the Land Use Board of Appeals and shall be raised and submitted before the record is closed. Issues must be raised with sufficient specificity to enable the Planning Commission to respond to the issue. Failure to raise an issue in person or by letter, or failure to provide sufficient specificity to afford the decision-maker an opportunity to respond to the issue, precludes appeal to the State Land Use Board of Appeals on that issue.
In addition, failure to raise constitutional or other issues relating to proposed conditions of approval, with sufficient specificity to allow the Planning Commission to respond to the issue, precludes an action for damages in circuit court.
The Planning Commission shall review the application under a Type III procedure and make a decision according to the applicable criteria specified above. This hearing may be continued without additional published notices. All interested persons are invited to attend and be heard.
